Town of Stillwater Subdivision Regulations

Authority of the Planning Board

By authority of a resolution adopted by the Stillwater Town Board on May 7,1974, pursuant to the provisions of N.Y.S. Town Law (Article 16), the Stillwater Planning Board was established.  The Stillwater Planning Board is empowered and authorized to approve plats for land subdivision within the Town, outside the limits of the incorporated Village of Stillwater.  All subdivision plats hereinafter submitted to the Planning Board for approval shall be governed by and subject to the provisions within the Subdivision Regulations for the Town of Stillwater. These regulations were adopted by the Stillwater Planning Board on March 3, 2003. Any application for subdivision made on or after March 3, 2003 must comply with these regulations.    (revised 03/03/2003)

Policy of the Planning Board

It is the policy of the Stillwater Planning Board to consider subdivision plats as part of a plan for the orderly, efficient and economical development of the Town.  This means, among other things, that the land to be subdivided shall be of such character that it can be used safely for building purposes without danger to health, or peril from fire, flood or other menace; that proper provision shall be made for drainage, water supply, sewerage and other needed improvements; that all proposed lots shall be laid out and of such size as to be in harmony with the development pattern of the neighborhood; that the proposed streets shall compose a convenient system and shall be properly related to the proposals shown on the Town of Stillwater Comprehensive Plan and shall be of such width, grade and location as to accommodate the prospective traffic, to facilitate fire protection and to provide access of fire fighting equipment to buildings; and that proper provision shall be made for open spaces for parks and playgrounds.

In order that land subdivisions may be made in accordance with this policy, these regulations which shall be known as, and which shall be cited as the "Town of Stillwater Land Subdivision Regulations" have been adopted by the Planning Board on December 28, 1981 and approved by the Town Board on January 7, 1982.
